These terms explain what Coastie Websites will do for you, what we ask of you, and what happens in various situations. In these terms, "we", "us" and "our" mean Coastie Websites. They're written in plain English. If anything is unclear, just ask at hello@coastiewebsites.co.nz.
Coastie Websites designs, builds, hosts, and maintains websites for New Zealand businesses. For $95 per month (NZD) your managed website plan includes:
Extra services, such as additional email addresses, paid integrations, specialist copywriting, photography, advertising, or unusually complex features, are only added if we agree them with you first. Additional email addresses are currently $5 per month each unless we agree otherwise.
Prices are in New Zealand dollars. If GST applies, this will be shown on your invoice or proposal. We may change our prices in the future, but we will give you notice before any price change applies to your plan. A price change will not affect any period you have already paid for.
We show you a design for your site at no cost and with no obligation. You don't pay anything until you've seen the design direction and decided you want to go ahead. If you choose not to proceed, you owe us nothing.
Your first payment is due when you approve the design direction and give us the go-ahead to build and launch your site. Approval can be given by email, message, form submission, invoice payment, or another written go-ahead. Payments are monthly, in advance. We will agree on a payment method with you at that point.
You can cancel at any time by emailing us at hello@coastiewebsites.co.nz. There is no lock-in contract and no cancellation fee. Your service will continue until the end of the billing period you have already paid for, after which the managed website service will end. Monthly fees are not usually refunded for a partly used billing period, unless we agree otherwise or New Zealand law requires a refund or other remedy.
If something goes wrong with our service, please contact us first so we can put it right. Where New Zealand consumer law applies, services must be provided with reasonable care and skill, be fit for an agreed purpose, be completed within a reasonable time if no timeframe was agreed, and be charged at a reasonable price if the price was not set in advance. Nothing in these terms limits any rights or remedies you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot be excluded.
Your monthly plan is an ongoing managed website service. Unless we agree otherwise in writing, the website design, layout, code and build remain owned by Coastie Websites, and your subscription gives you the right to use the website while your plan is active. If you cancel, the hosted website service will end after your paid period.
You keep your domain name and any content you supplied, such as text, photos and logos. We will provide reasonable help to transfer your domain name and supplied content to you, provided your account is up to date and the transfer is technically possible under the relevant provider's rules.
If a payment is missed or fails, we will contact you and give you a reasonable chance to put it right. If payment remains overdue, we may pause updates, suspend the website, email, or hosting service, or take the website offline until the account is brought up to date. We will not transfer away or dispose of your domain name or your supplied content because of a missed payment.
Updates to your existing site are included as part of your monthly plan. This usually means changes such as wording, prices, hours, photos, testimonials, contact details, adding or removing sections, and keeping your content fresh. We aim to complete straightforward updates within 2 business days.
If you ask for something that is really a new feature or a major rebuild rather than an update, we'll talk it through first and agree what makes sense before any extra cost applies.
To allow us to build and maintain your site effectively, we ask that you:
We will:
We aim to keep your website available at all times, but we cannot guarantee uninterrupted service. Hosting providers occasionally experience outages, and planned maintenance may require brief downtime. We will endeavour to minimise disruption.
To the extent permitted by New Zealand law, Coastie Websites is not liable for indirect or consequential loss, including loss of business, revenue, or data. Our total liability for a claim is limited to the amount you paid us for the service in the 3 months before the issue arose, except where the law does not allow that limitation.
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot be excluded.
We may update these terms from time to time. If we make a significant change, we will let you know by email before the change applies. Changes will not affect any period you have already paid for, and you can cancel before the updated terms apply if you do not want to continue.
These terms are governed by the laws of New Zealand. Any disputes will be resolved under New Zealand jurisdiction.
If you have any questions about these terms, please get in touch at hello@coastiewebsites.co.nz.
